- On Tuesday, USCIS filed in the Federal Register plans to increase EB-5 visa application fees by an average of 70 percent, affecting roughly 16,600 applicants annually and introducing a new $10,000-plus fee for investors whose projects collapse.
- Created in 1990, the EB-5 program allows foreign investors to pursue a green card by investing $800,000 in a Targeted Employment Area or qualifying business that must create at least 10 full-time jobs.
- DHS set the main EB-5 application fee at $7,615, lower than the originally proposed $9,625; USCIS introduced form I-527, charging a $10,330 fee for older investors needing to preserve eligibility if projects fail.
- USCIS stated the agency is largely funded by fees rather than taxes; "The cost of reviewing applications, conducting background checks, verifying eligibility, detecting fraud, and maintaining program operations must be paid by those who use the immigration system," the release said.
- These new fees take effect November 30, 2026; the broader EB-5 program remains authorized through September 30, 2027, with USCIS expecting Congress to extend the visa pathway once more.
