FTC orders Walmart, Delta and others to share how they use personal data to set prices and pay

The agency will study how 11 firms use personal data and AI to set individualized prices, wages and job offers, officials said.

  • On Wednesday, the Federal Trade Commission ordered Walmart, Uber, and seven other companies to provide detailed information on how they use consumer data to set individual prices and wages.
  • The advance of algorithmic pricing technology has fueled concern that companies set prices on an individual basis to extract the maximum amount each shopper is willing to pay, though these strategies remain difficult to observe from outside.
  • "Consumers deserve to know whether companies use their web surfing habits or other personal data to estimate the highest price they can charge each consumer," said FTC Chairman Andrew Ferguson. The commission is also examining how delivery services determine compensation for gig workers.
  • Delta stated it has "zero tolerance for discriminatory or predatory pricing" and does not use personal data for individualized offers, while Walmart's CEO stated last month the retailer does not use personal information like income to set prices.
  • Legislators in at least 30 states have considered pricing-related bills this year, as the FTC flexes its consumer protection powers ahead of the U.S. congressional elections next week when voters rank cost of living as a top issue.
