Federal judge rules in favor of allowing SCOTUS case over trans athletes to proceed after attempt to dismiss
The lawsuit challenging Idaho’s House Bill 500 will proceed despite dismissal attempts, with the state defending its law as ensuring fair competition, court records show.
- On Tuesday a federal judge in Idaho denied Lindsay Hecox's request to dismiss her challenge to the law banning transgender women and girls from women's sports, keeping the lawsuit pending before the U.S. Supreme Court.
- Hecox first sued in 2020 after the Idaho Legislature passed House Bill 500 banning transgender women and girls from women's sports, and a U.S. District Court injunction was upheld by the 9th Circuit; last year the state asked the Supreme Court to review it.
- Attorneys for Hecox told the Supreme Court on Sept. 2 that continuing the lawsuit would increase harassment affecting her health and graduation, while the American Civil Liberties Union said she is not in covered programs and wants to finish her degree.
- U.S. District Judge David Nye said the state has a `fair right to have its arguments heard and adjudicated once and for all`, and Labrador celebrated the District Court ruling, saying Idaho can now present its case to the nation’s highest court.
- Earlier this year the state asked the U.S. Supreme Court to review the case, and in July it accepted it, framing the dispute as a national fight, Idaho officials said.
