Federal judge dismisses former Trump supporter’s defamation lawsuit against Fox News
The judge said Raymond Epps failed to show Fox News knew its claims were false, ending the defamation case for a second time.
On Friday, District Judge Jennifer L. Hall dismissed the defamation lawsuit against Fox News for a second time, ruling that Raymond Epps failed to prove the network knowingly broadcast false information about the Capitol insurrection.
A former Marine, Epps claimed Fox aired conspiracy theories falsely identifying him as a government plant during the Jan. 6 riot, alleging these reports triggered death threats that forced him to sell his Arizona ranch.
The lawsuit cited more than two dozen segments on Tucker Carlson's show promoting these theories; Epps pleaded guilty to a Jan. 6 misdemeanor and was later pardoned by Donald Trump alongside 1,500 others.
Federal prosecutors have consistently refuted claims that Epps acted as an FBI operative, while lawyers for Epps argued Fox News targeted him as a "scapegoat" to deflect blame from Donald Trump and the Republican Party.
This second dismissal significantly weakens Epps' legal efforts to seek damages, as the court found insufficient evidence that Fox News knowingly broadcast false claims regarding the network's Jan. 6 coverage.
