Federal court upholds Oklahoma law banning gender-affirming care for minors

OKLAHOMA, AUG 7 – The Tenth Circuit ruled Oklahoma's Senate Bill 613 constitutional, banning puberty blockers and hormone therapy for minors and imposing felony penalties on providers, following a similar Supreme Court decision.

  • On Wednesday, Aug. 6, the Tenth Circuit Court of Appeals upheld Oklahoma’s SB 613, which bans gender-affirming care for minors and threatens providers with felony convictions.
  • Enacted in 2023, SB 613 was signed by Governor Kevin Stitt and challenged by five families of transgender children and a physician under the Equal Protection Clause and Section 1557, but the Tulsa federal district court upheld it.
  • The court held “there is no deeply rooted tradition in parents’ rights to access gender transition procedures for their children,” and found “no evidence exists” that the Oklahoma Legislature enacted SB 613 to discriminate, Circuit Judge Joel M. Carson wrote.
  • “We’re grateful the battle is now won,” Oklahoma Attorney General Gentner Drummond said, praising the ruling while the ACLU called it “a devastating outcome for transgender youth and their families across Oklahoma.”
  • Following the Supreme Court’s June ruling upholding Tennessee’s ban in U.S. v. Skrmetti, the Tenth Circuit applied that precedent in Oklahoma.
