Elections BC Allows Petition Bid for Indigenous Law’s Repeal to Proceed
The petition needs signatures from 10% of voters in all 93 districts by Jan. 25, 2027, Elections BC said.
- On Thursday, Elections BC granted in-principle approval to a petition seeking the repeal of the Declaration on the Rights of Indigenous Peoples Act , led by Conservative transportation critic Harman Bhangu.
- Designed to affirm the United Nations Declaration within British Columbia law, DRIPA has become a flashpoint; a B.C. Appeal Court ruling last year found provincial mining rules inconsistent with the act.
- To succeed, the petition requires signatures from 10 per cent of voters in all 93 electoral districts by Jan. 25, 2027. Elections has approved only one successful petition since 1995.
- Premier David Eby previously retreated from suspending DRIPA amid opposition from First Nations leaders; the proposed repeal bill would come into force upon royal assent if passed.
- If the petition succeeds, referral to the legislature follows, though the process is not binding. Officials may recommend introducing the draft bill or refer the petition for a vote.
