GQEBERHA, SOUTH AFRICA, JUL 13 – The National Prosecuting Authority seeks clarity on key factual findings in the acquittal judgment to enable a legal appeal against televangelist Timothy Omotoso and co-accused.
- On 14 July 2025, the National Prosecuting Authority submitted a request to the Gqeberha High Court asking Judge Irma Schoeman to clarify her April decision that cleared Timothy Omotoso and his co-defendants of multiple allegations related to sexual misconduct and trafficking.
- The NPA sought the clarification to better prepare an appeal, but Omotoso's lawyer Peter Daubermann argued the request was procedurally impermissible as the judgment was final and the appeal deadline missed.
- The eight-year trial involved 32 charges against Omotoso and others, who faced accusations from church members, and the judge cited poor prosecution quality for acquitting them in April 2025.
- Daubermann warned that granting the state’s request would undermine legal certainty by allowing judgment reconsideration after finalization, calling the application a retrospective 'fishing expedition.'
- Judge Schoeman will deliver her ruling on the clarification request by 22 July 2025, which will determine the NPA’s ability to pursue an appeal before the Supreme Court of Appeal.
