Virginia Supreme Court Refuses to Review AG’s Appeal in College Board Appointees Case
The court ruled the Virginia General Assembly has sole authority to confirm university board appointees, blocking four Youngkin nominees from GMU board activities.
- On Monday, the Supreme Court of Virginia refused the petition for review and upheld a preliminary injunction blocking the four disputed appointees from participating on the George Mason University Board of Visitors.
- On July 29, Circuit Court Judge Jonathan D. Frieden granted an injunction after a mid-July complaint filed by State Sen. L. Louise Lucas, contending Virginia Gov. Glenn Youngkin circumvented the Virginia General Assembly under the Code of Virginia.
- Frieden's injunction blocks Charles J. Cooper, William D. Hansen, Maureen Ohlhaussen, and Caren Marrick from participating in GMU board activities, including meetings and votes.
- The decision denied the appeal filed in August by Virginia Attorney General Jason Miyares, and the case will return to Fairfax County Circuit Court with no trial date set as Youngkin’s term ends in January.
- The order affirms the Virginia Senate Privileges and Elections Committee's authority to refuse confirmations, rejecting eight Youngkin appointments to the three boards, Virginia Senate Leader Scott Surovell said it's `transformative`.
