Where a wholesale mortgage lender has moved for partial summary judgment on liability, that motion should be allowed in part, as the defendant fails to show that a disputed liquidated damages provision is invalid as a matter of law, but the motion should be denied without prejudice as to enforceability of the liquidated damages provision
