California police cite anti-truancy law in charge against man who helped students protest ICE

Prosecutors said the evidence could not prove Aldrete encouraged a minor to become delinquent under California Penal Code section 272.

  • On Tuesday, The Fresno County District Attorney declined to pursue charges against Alfred Aldrete, 41, whom The Clovis Police Department had referred for contributing to the delinquency of a minor during a February student walkout.
  • Clovis police had investigated Aldrete for his role escorting about 50 students protesting Trump immigration policies, identifying him as directing student activity and entering the roadway, which they claimed impacted traffic flow.
  • Under California Penal Code Section 272, prosecutors must prove an adult encouraged a minor to become delinquent. Taylor Long, a spokesperson for Smittcamp, stated the evidence could not be proven beyond a reasonable doubt.
  • Filing about 20 such charges annually, The Fresno County District Attorney's Office rarely pursues protest-related cases, allowing this matter to dissipate quickly and sparing Aldrete from potential prosecution.
  • Meanwhile, The Los Angeles Police Department is considering charges against immigration-related protest participants under the same Penal Code section, confirming long-held suspicions from Aldrete that police were targeting him for activism.
