- Seeking a seven-day visit to Johns Hopkins Hospital in the USA, Banerjee had requested permission to continue specialized treatment under a medical team he had been consulting for years. Justice Bhattacharya deemed independent medical verification necessary before approving foreign travel.
- The Court observed that around 15 criminal cases are currently pending against Banerjee, with proceedings continuing in several of them. The State opposed the request, contending there was no medical emergency warranting treatment abroad.
- Senior Advocate Rebecca John argued that Banerjee had previously received permission for similar treatment during Enforcement Directorate proceedings and visited the USA 12 times between 2023 and 2025 without missing scheduled dates.
- The ruling follows a Supreme Court directive issued Monday requiring the High Court to dispose of the appeal within a week, after repeated refusals to grant expedited hearings since June.
