Buc-Ee’s Sues Convenience Store over Beaver Logo, Alleges Trademark Infringement
The chain says the store’s beaver logo and red color could confuse customers and unfairly benefit from Buc-ee’s trademark.
On July 28, Texas-based travel center chain Buc-ee's filed a federal lawsuit against Beaver's Mini Mart, a small Beavercreek, Ohio, convenience store, alleging its cartoon beaver logo and red coloring infringe on the chain's federal trademarks.
Buc-Ee's claims 'consumers are likely to perceive a connection' between the brands, though owner Boparai notes his store has operated since around 2017 and lacks gas pumps, distinguishing it from the massive travel center chain.
Community members organized a 'cash mob' for Friday, August 4, to support the local shop, while Beavercreek residents and officials expressed shock over the legal action given the city's long history of using beaver imagery in local branding.
Buc-Ee's has sued as many as a dozen companies over trademark infringement, including Ohio-based Mickey Mart. Comedian John Oliver recently mocked the chain's tactics, launching 'Buc-off' merchandise to challenge the company to sue him.
Owner Boparai plans to fight the lawsuit, while other local businesses worry they could be targeted next. Separately, Teddy's Market filed a counterclaim in a separate case alleging Buc-ee's obtained its trademarks fraudulently.
