Brothers accused of assaulting police officer at Manchester Airport will not face third trial
Prosecutors said a third retrial was not justified after two juries deadlocked on the assault allegation, leaving one brother to face sentencing on other convictions.
Today, the Crown Prosecution Service dropped the third trial against brothers Mohammed Fahir Amaaz and Muhammad Amaad for allegedly assaulting PC Zachary Marsden after prosecutors offered no evidence following two deadlocked juries.
Originating at Manchester Airport on July 23, 2024, the incident involved Amaaz and Amaad assaulting a man in Starbucks before police arrived; both brothers claimed they acted in self-defense.
Prosecutor Paul Greaney KC stated the law requires a "clear presumption" against third trials absent "exceptional circumstances," a threshold not met after the second jury deliberated for approximately 19 hours and 48 minutes.
While Amaad walks free following the decision, Amaaz remains in custody awaiting sentencing on June 26, 2026, for previous assault convictions involving two police officers and a member of the public.
A police watchdog investigation into PC Marsden remains ongoing, examining footage showing the officer kicking Amaaz on the ground and witness testimony regarding a "stamping motion" during the altercation.
