LabCorp Reaches $2.3M Multistate Settlement over Patient Data Breach

- On Thursday, a coalition of 44 attorneys general reached a $2.3 million settlement with Laboratory Corporation of America , resolving an investigation into a 2019 data breach at its debt collector, American Medical Collection Agency .
- Between August 1, 2018, and March 30, 2019, a hacker entered AMCA's internal system, compromising personal information of more than 27.5 million people, including roughly 10.2 million Labcorp patients.
- Labcorp must implement "critical reforms to protect consumers," including a revamped vendor risk management program and hiring a Third-Party Assessor for ongoing security audits.
- Attorney General Kathy Jennings stated that "the responsibility to manage and protect consumers sensitive personal information cannot be outsourced," affirming HIPAA-covered entities retain an obligation to oversee third-party vendors.
- Separately, Labcorp agreed to a $35 million settlement in a related ongoing class-action lawsuit, supplementing a previous multistate settlement with AMCA that included a $21 million suspended payment due to the vendor's bankruptcy.
