Arizona Asks US Supreme Court to Halt Prison Healthcare Takeover in ‘Hail Mary’ Filing
State attorneys say the prison system has made tangible progress and urge the justices to reject a receivership they call a remedy of last resort.
- On Wednesday, Arizona attorneys filed an emergency request with the U.S. Supreme Court to delay the October 19 takeover of the state's prison health care system, arguing the state should retain control of its budget and operations.
- U.S. District Judge Roslyn Silver ordered the receivership in February after court-appointed monitors reported the Department failed to comply with 131 of 154 quality indicators, citing nearly 14 years of constitutional violations regarding inmate medical and mental health care.
- Attorney Paul Clement argued the receivership is a "remedy of last resort" that ignores "tangible progress," while attorneys for roughly 25,000 inmates called the state's filing a "Hail Mary" attempt to block necessary constitutional reforms.
- Justice Elena Kagan, who handles special requests on the court's "shadow docket," will decide whether to seek a response from inmates' attorneys or refer the matter to the full court.
- Unless the justices intervene, Annette Chambers-Smith, former director of the Ohio Department of Rehabilitation and Correction, will assume control on October 19 and exercise powers to set budgets and terminate contracts addressing constitutional failures.
