State Officials Evaluating Unpermitted xAI Turbines in Southaven
The lawsuit says nearly 50 unpermitted turbines are worsening air quality and exploiting a state loophole that treats trailer-mounted plants as mobile.
In May 2026, the NAACP and the Mississippi State Conference of the NAACP filed a preliminary injunction lawsuit against xAI and MZX Tech to immediately halt the use of 46 unpermitted natural gas turbines at 2875 Stanton Road.
Regulators classify the power plants 'mobile' because they sit on flatbed trailers, allowing xAI to bypass Clean Air Act regulations for one year despite potential health risks to nearby communities in Southaven.
Of the 46 turbines operating at the site, only 14 feature Selective Catalytic Reduction technology to reduce emissions, conflicting with updated Environmental Protection Agency regulations requiring permits for all turbines, temporary or permanent.
Southern Environmental Law Center Senior Attorney Ben Grillot called the operations "an insult to families" and illegal, stating "xAI must be held accountable for its reckless, unlawful actions and that's exactly what this lawsuit aims to do."
The Mississippi Department of Environmental Quality approved a Prevention of Significant Deterioration permit for 41 future permanent turbines on March 10, though the timeline for replacing temporary units and alignment with federal standards remains unclear.
