US SEC dismisses case against SolarWinds, top security officer

The SEC dropped its civil case after a judge dismissed most allegations; about 18,000 organizations were affected by the 2020 Sunburst cyberattack, officials said.

  • On Thursday, the U.S. Securities and Exchange Commission said it abandoned litigation against SolarWinds Corp and Timothy G. Brown, Chief Information Security Officer, tied to the Sunburst cyberattack, filing a joint motion to dismiss the case with prejudice.
  • Two years ago the U.S. Securities and Exchange Commission alleged SolarWinds Corp and Timothy G. Brown, Chief Information Security Officer , misled investors, and a judge mostly set aside many allegations last year.
  • Around 18,000 organizations downloaded the poisoned software, and about 100 were later hacked by Russia's Cozy Bear, impacting major firms and U.S. agencies.
  • The SEC noted in its filing that its dismissal is `in the exercise of its discretion` and `does not necessarily reflect the Commission's position on any other case`, SolarWinds CEO Sudhakar Ramakrishna said it `marks the end of a transformative chapter for SolarWinds and the beginning of our next.`
  • Amid broader regulatory shifts, the dismissal halts a divisive Biden administration effort on security failings and coincides with the Federal Communications Commission rescinding Biden-era cyber regulations.
