RCN Executive Asserts Union Neutrality on Transgender Definition at Sandie Peggie Tribunal
The union said it has no position on the gender debate as its 600,000 members face questions over Pride-branded badges and neutrality.
On Wednesday, RCN England chief executive Patricia Marquis testified at an employment tribunal in Dundee where nurse Sandie Peggie claims the union discriminated against her for her gender-critical beliefs.
Peggie initiated the legal case after the RCN allegedly refused to support her during a 2023 dispute with NHS Fife involving transgender medic Dr Beth Upton, claiming the union is 'in the grip' of 'trans activists.'
During cross-examination, barrister Naomi Cunningham highlighted that the RCN sells badges featuring the Progress Pride flag, which Marquis agreed is 'strongly associated with gender ideology.'
Marquis insisted the union maintains 'no position' on whether trans women are women, aiming to balance the views of its 600,000 members while rejecting claims that RCN insignia are intended to exclude anyone.
Both parties are expected to deliver closing submissions on Thursday before employment judge Melanie Sangster to determine if the union's conduct amounted to direct discrimination against Peggie.
