One fun­da­men­tal prin­ci­ple of fair­ness upon which our crim­i­nal jus­tice sys­tem relies is the notion that pros­e­cu­tors must dis­close excul­pa­to­ry, mate­r­i­al evi­dence favor­able to defen­dants.
