Trump administration asks Washington to set aside ballots from 400 voters it says may be noncitizens
The department said 1,500 votes were cast by the 400 people and wants ballots held until eligibility is confirmed.
On Monday, October 26, 2026, the Justice Department asked Washington state to set aside ballots from over 400 people it suspects are not United States citizens.
This request mirrors similar federal efforts in California to sequester ballots from up to 20,000 people, though Nevada investigations found zero noncitizen voters despite administration claims of 1,500.
Acting U.S. Attorney Neil Floyd announced the demand, citing 1,500 votes cast by these individuals in prior elections; the agency noted some may have since become naturalized citizens.
Washington Secretary of State Steve Hobbs is reviewing the demand and stated he will only respond to requests following due process because he does not "want Washingtonians to be harassed."
The Justice Department anticipates sending Washington additional lists of suspected noncitizens before Election Day, while Hobbs' office has received about 60 subpoenas seeking voter information since last month.
