Over 10,000 Hotels Join Complaint Against Booking.com

GERMANY, AUG 3 – The class action lawsuit challenges Booking.com’s anti-competitive pricing clauses that blocked hotels from offering cheaper rates elsewhere, supported by over 30 national associations and 10,000 hotels.

  • More than 10,000 hotels across Europe are joining a class action against Dutch-based Booking.com, to be heard in an Amsterdam court and coordinated by the Hotel Claims Alliance, with support until August 29.
  • Over the 2004–2024 period, hotels claim the European Court of Justice's September 19, 2024, ruling found rate parity clauses anti-competitive, restricting lower rates on hotels' own websites and other platforms.
  • HOTREC and more than 30 national hotel associations support the suit, with IHA Managing Director Markus Luthe stating `'The class action is receiving overwhelming support'`.
  • Following pressure from the European Digital Markets Act, Booking.com said it has not received formal notification of legal proceedings and dismissed the allegations as mischaracterizations, stressing that hotel partners are free to set their own pricing.
  • At a 71% market share across Europe in 2023, Booking.com dominates, and preliminary estimates suggest hotels could recover 30% of commissions paid since 2004.
