Governor Kevin Stitt issued an executive order this week calling for a state question to be placed on April ballots asking voters whether Oklahoma should hold a constitutional convention—but some lawmakers and Attorney General Gentner Drummond say the governor doesn’t have the authority to do it.

Stitt Sets April Vote on Oklahoma Constitutional Convention

Governor Kevin Stitt has set a special election for April 6, 2027, asking Oklahoma voters whether the Legislature should call a state constitutional convention. Article 24, Section 2 of the Oklahoma Constitution requires the question to be submitted to voters at least once every 20 years. According to the governor’s office, Oklahoma voters last considered the question in 1970. “The Oklahoma Constitution is clear. At least every 20 years, Oklahomans have the right to decide whether it’s time to call a constitutional convention,” Stitt said. “It’s been 56 years since the question was sent to the people.” Along with the proclamation setting the election, Stitt issued Executive Order 2026-30 directing the Secretary of State to take the necessary steps to place the question before voters. The order also creates the Oklahoma Constitutional Convention Commission, which will study the state Constitution and constitutional conventions held in other states. The commission will recommend procedures and rules for an Oklahoma constitutional convention if voters approve the state question. It will also consider potential safeguards and legislation needed to carry out a convention. The commission’s report is due by Dec. 31.
