Planned Parenthood Can Refer Indiana Abortion Patients Out-of-State, Federal Appeals Court Rules
The court said Indiana’s law could not bar factual referrals because it imposed a content-based speech restriction and failed strict scrutiny.
- On Tuesday, the U.S. Seventh Circuit Court of Appeals ruled Indiana cannot prohibit doctors from telling minors where to obtain out-of-state abortions, upholding a permanent injunction against the 2017 law.
- Indiana's 2017 'aid-or-assist' law forbade professionals from aiding minors in obtaining abortions unless they satisfied parental consent requirements, a restriction the court found violated the First Amendment.
- Rejecting the state's argument that the speech was 'integral to unlawful conduct,' the court wrote, 'This argument is of course circular: the speech is integral to unlawful conduct because the challenged restriction on speech makes it unlawful.'
- The ruling confirms the permanent injunction granted in 2024 by Judge Sarah Evans Barker, following the 2017 lawsuit by Planned Parenthood Great Northwest, Hawai'i, Alaska, Indiana, Kentucky, Inc. and the ACLU of Indiana.
- While Indiana Attorney General Todd Rokita's office did not immediately respond to the decision, the Indiana Supreme Court is scheduled to hear oral arguments in a separate abortion-related case next month.
