The Paris Administrative Court considered the situation of nurse Majdouline B., excluded by the AP-HP for refusing to remove his calot. The argument of hygiene was breached, remains that of the duty of obedience of the official. The nurse would like to see discrimination retained.
Once again suspended in January, Majdouline B. was back Friday, October 2nd before the administrative court in Paris. The Parisian hospital blames him for refusing to withdraw his head covering, his lawyer denounces a "discrimination".
At the hearing before the Administrative Court on 2 October, the director of the public hospital sector of Île-de-France failed to justify the "proportional" nature of the dismissal of a nurse for wearing a calot. The lack of hygiene, as a reason for it, was swept away.
On Friday, 2 October 2026, the administrative judge examines a conflict between a nurse who was wearing a calot and the public hospital which dismissed him, the latter seeing it as a religious sign contrary to the duty of neutrality of the civil servants.
