The Legal Aid Board has refused to allow the case to come before the Supreme Court. This is according to Peter Madsen's defense lawyer, Tobias Stadarfeld. Now Peter Madsen and his lawyer are planning to take the case to the European Court of Human Rights in Strasbourg instead.
