German Court Does Not yet Allow Seizure of Emergency Tanker “Shadow Fleet” of the Russian Federation
The German court has not yet given consent to the seizure of the emergency oil tanker Eventin, which is on the list of vessels of the Russian “shadow fleet”. The ship has been off the coast of the island of Rügen for almost a year.
The German customs may not collect and exploit the damaged oil tanker "Eventin". This was decided by the Bundesfinanzhof. He has doubts about the legality of the measure. According to the court, it is not clear whether a violation of EU sanctions rules exists even if a ship is incapacitated and drifts into EU waters without a decision of its own will.
According to the Bundesfinanzhof, the recovery of the tanker and its cargo - 99,000 tons of Russian oil - ordered by the German customs is not permitted.
The tanker »Eventin« may be part of the Russian shadow fleet. Nevertheless, Germany must not seize the ship loaded with around 100,000 tons of oil for the time being.
For months, an oil tanker has been in front of Rügen, who is attributed to Russia's shadow fleet. The Federal Finance Court doubts that the customs may move in ship and cargo.
