Latham on the Hook for $500k Payout as Appeal Quashed
Three appeal judges upheld the defamation ruling and left Mark Latham facing more than $500,000 in damages and legal costs, court records show.
On Wednesday, three Federal Court judges dismissed both the appeal and cross-appeal regarding a defamatory social media post. Independent MP Mark Latham remains liable for more than $500,000 in damages and legal costs owed to Sydney MP Alex Greenwich.
The legal conflict stems from a 2023 state election, when Latham posted an explicit tweet describing a sex act in response to Greenwich. The Federal Court previously found the post exposed Greenwich, an openly gay MP, to hatred and ridicule.
Justice Craig Colvin wrote that Latham's words were "a blatant attempt to denigrate" rather than genuine debate. Justices Michael Wheelahan and Wendy Abraham added disparaging Greenwich for sexual acts was "not a relevant response" to political criticism.
Alex Greenwich said "justice is a long game" following the appeal decision, noting the ruling confirms there is no place for such conduct in civil discourse. Latham previously described proceedings as a "Mad Hatter's Tea Party."
Latham remains liable for more than $500,000 in damages and legal costs. Following Wednesday's judgment, both parties were ordered to confer on final appeal costs and submit findings to the court by June 17.
