Lawyer says Myles Gray met Vancouver officer with aggression in fatal arrest
The hearing is hearing from officers for the first time after a 2023 inquest ruled Gray’s death was a homicide.
On Oct 13, 2026, the Office of the Police Complaint Commissioner began a hearing examining whether seven Vancouver police officers used unnecessary force during the 2015 arrest of Myles Gray.
A 2023 inquest previously ruled the death a homicide, though a disciplinary process determined none of the seven officers committed misconduct and no criminal charges were laid.
Lawyer Mike Shirreff, representing Const. Eric Birzneck, argued the officer was "met with aggression" by Gray, claiming the force used was necessary because he believed an assault was imminent.
Birzneck began testifying on Oct 13, with three of the six other involved officers—Beau Spencer, Nick Thompson, and Josh Wong—also scheduled to provide testimony during the proceedings.
Previous inquest testimony revealed Gray suffered severe injuries, including a fractured eye socket and crushed voice box, with a paramedic noting the bruising was so extreme he misidentified Gray's race.
