Safeway, Albertsons Sued over ‘Deceptive’ Buy-One-Get-One Discounts

- The lawsuit, filed in King County Superior Court, claims the retailer routinely raised prices on items before BOGO promotions, then lowered them again shortly after the deals ended to create an illusion of savings.
- State officials allege that between October 2019 and May 2024, the pricing practices affected more than 3 million transactions, generating as much as $19.7 million in additional revenue for Boise-based Albertsons.
- In a statement, the company said it "strongly disagree with its claims," citing "flawed analysis and data errors" while noting it remains committed to complying with the law.
- The company previously paid $107 million to settle a 2016 Oregon BOGO lawsuit and also faced legal action when Washington blocked its failed merger attempt with rival grocer Kroger.
