Justice Department backs xAI in NAACP air pollution suit
The Justice Department says stopping the turbines would threaten national, economic and energy security because xAI supports military operations, court filings show.
On Monday, the Department of Justice intervened in the NAACP lawsuit against xAI, siding with the company and arguing that stopping gas turbines "threatens American national, economic, and energy security."
The NAACP filed the lawsuit in April, alleging xAI's unpermitted gas turbines at Colossus 2 in Southaven, Mississippi, violate the Clean Air Act and endanger public health.
Since April, turbine counts grew from 27 to 57, causing a 111 percent increase in NOx emissions and significant spikes in Formaldehyde and PM2 levels.
Cameron Stanley, the Defense Department's chief digital and AI officer, stated the Grok Gov Model supports "vital national security missions," including recent strikes in the Iran War.
Earth Justice, representing the NAACP, characterized the DOJ's motion as a "massive power grab," while residents reported "near-constant noise, vibrations and other nuisance-level harms.
