Judge lifts restraining order, Morrisey’s state hospitals sale can be finalized
Marion County Circuit Court Judge Matthew S. Delligatti, on Oct. 28, 2025, lifted a restraining order halting the sale of Hopemont Hospital, Jackie Withrow Hospital, Lakin Hospital and John Manchin Sr. Health Care Center to the Marx Development Group. West Virginia Gov. Patrick Morrisey and the Department of Health Facilities Secretary Michael Caruso were sued to stop the sale.

FAIRMONT, W.Va. (WBOY) — Marion Circuit Court Judge Matthew Deligatti has ruled to remove a temporary injunction that was made to stop the sale of the state-run John Manchin Senior Health Care Center in Fairmont. The temporary injunction formerly stopped the sale of Manchin to Marx Development Group.
