The Court of Appeal of Valparaíso today –Thursday, June 11th – received an appeal for protection against the General Treasury of the Republic (TGR) and terminated the procedure for collecting State-backed credit (CAE), when estimating this type of credit are not subject to enforcement by means of tax regulations.
In a divided decision, the Third Chamber granted an appeal for protection against the GRT and annulled the recovery proceedings initiated against a debtor of the GPA. The court held that this claim cannot be executed as a tax debt.
The Court of Appeal concluded that the mechanism used restricts the debtor ' s possibilities of defence and violates the guarantee of equality before the law.
