Major Changes to Medical Marijuana Law May Be Coming to Georgia
Senate Bill 220 aims to enhance medical cannabis access by removing the THC cap, allowing vaping, and adding lupus as a qualifying condition for 34,500 registered patients.
- On Monday, the Georgia General Assembly gave final approval to Senate Bill 220, with the House voting 144-21 to lift the state's THC cap and allow registered patients to vape medical cannabis. Senate Bill 220 now advances to Gov. Brian Kemp.
- After about 11 years operating with a 5% THC cap, Georgia's medical marijuana program has restricted patients to low-potency oils and maintains among the lowest adoption rates of the 42 states with programs. Advocates pushed reform to expand patient access.
- Senate Bill 220 removes the THC percentage cap, renames products from "Low THC Oil" to "medical cannabis", and permits vaping for faster relief. The bill also adds lupus as a qualifying condition and requires treating physicians to practice principally in Georgia.
- Gov. Brian Kemp can sign the bill, allow it to become law without his signature, or veto it. Patient advocate Shannon Cloud, whose 20-year-old daughter uses medical cannabis for seizures, called the changes "badly needed improvements" for flexibility and faster relief.
- The Senate passed its amended version 38-14 on Wednesday after the House previously approved an earlier version 138-21. Sen. Ed Setzler, R-Acworth, expressed "grave concerns" about raising THC, warning it would allow people to inhale concentrated THC rather than address low-potency oil limitations.
