Deposed Venezuelan President Nicolas Maduro asks judge to toss out indictment against him
Maduro's legal team claims U.S. sanctions block Venezuelan funds for his defense, violating his Sixth Amendment rights in a drug trafficking case, court papers say.
- Barry Pollack filed papers in Manhattan federal court Thursday asking a judge to dismiss the indictment, arguing U.S. action blocked funds for Nicolás Maduro's defense and included Maduro's declaration of entitlement to government-funded counsel.
- The Treasury Department's Office of Foreign Assets Control said it approved a Jan. 9 license for Venezuela to pay legal fees, then rescinded it within three hours while allowing payments for Cilia Flores.
- The indictment charges Maduro with working with cartels to ship cocaine, and Pollack said `Mr. Maduro, as Venezuela’s head of state, has both a right and an expectation to have legal fees associated with these charges funded by the government of Venezuela`.
- Pollack warned the trial could be constitutionally defective without restored Venezuelan funds and said he will resign if charges remain, forcing the court to appoint counsel at United States taxpayers' expense.
- Amid U.S.-Venezuela policy tensions, Maduro and his wife have been in U.S. custody since early January after the U.S. military seized them, with the fee dispute linked to policies since 2019.
