Court Grants Perikatan Stay on RoS Deregistration, Allows Coalition to Contest Melaka State Polls

The court said Perikatan may continue political activities while it challenges the Registrar of Societies’ suspension and deregistration orders.

  • On Thursday, the Malaysian High Court granted Perikatan Nasional a stay on its suspension and deregistration, allowing the coalition to resume political activities, including contesting the Melaka state election on Nov 14.
  • The Registrar of Societies had suspended the coalition on Sept 23, citing an alleged breach of Clause 7.1 of its Constitution for failing to invite Parti Pribumi Bersatu Malaysia to a July 16 Supreme Council meeting.
  • Justice Azizan Md Arshad cited "extraordinary circumstances" for the ruling, noting the deregistration occurred Oct 20, two days before the 30-day notice period stated in the Sept 22 document lapsed.
  • With the stay in effect, Perikatan can now resume campaigning and holding meetings, activities previously prohibited by the suspension order, as the court determined there was no prejudice to respondents if the stay was granted.
  • The court has not yet determined the validity of the ROS action that deregistered the coalition; Justice Azizan stated that the effect or validity of such exercise may still be challenged in future substantive hearings regarding the judicial review.
