Civil liberty advocates sue Illinois over 'show your papers' gun law
The complaint says the law forces residents to seek state permission before possessing firearms and shifts the burden of proof to citizens.
- On Tuesday, the New Civil Liberties Alliance filed a federal lawsuit challenging the constitutionality of the Illinois Firearm Owners Identification Act, naming Illinois State Police Director Brendan Kelly, Attorney General Kwame Raoul, and Cook County State's Attorney Eileen O'Neill Burke as defendants.
- Currently, Illinois and Massachusetts are the only two states requiring blanket licensing for gun possession, which NCLA argues treats firearm ownership as a state-granted privilege rather than a right.
- Three plaintiffs—Navy veteran Christopher Laurent, Chicago restaurant owner Kim Dalton, and liberty advocate Justin Tucker—joined the suit, stating they "refuse to submit to the state's unconstitutional procedure, and are unwilling to subject themselves to criminal prosecution by violating the law."
- NCLA Senior Litigation Counsel Jacob Huebert explained the group seeks to nullify the law, arguing it unconstitutionally places the burden of proof on citizens, stating, "The court should explain to Illinois officials that they can't force people to get a license."
- Despite having the second-strongest gun laws in the country, Illinois ranks 13th nationally in gun homicides, averaging 8.2 deaths per 100,000 residents, and the federal court will now determine whether the state's licensing system can legally stand.
