Brittany Higgins says she can ‘breathe again’ after Lehrmann’s appeal bid fails
- On Wednesday the Full Court will hand down its decision, with Justices Michael Wigney, Craig Colvin and Wendy Abraham delivering the ruling at 10.15am .
- Lehrmann's lawyer Zali Burrows argued Justice Michael Lee lacked sufficient evidence and denied procedural fairness, noting he went "on his own fact-finding mission," shortly after which Lehrmann lodged an appeal.
- Justice Michael Lee found on the balance of probabilities that Lehrmann raped Brittany Higgins on March 23, 2019, and that he was reckless about her consent, with Dr Matt Collins stating `The sting of the imputation resides in the act of intercourse without consent, not in any detail of it.`
- Justice Michael Lee ordered Lehrmann to pay $2 million to Network Ten, currently on hold, while Lehrmann is impecunious and Ten paid $1.15 million to Wilkinson earlier this year.
- The appeal hearing ran only two of the three days set aside in August, shortening oral arguments, and the Full Court of the Federal Court warned consequences will follow for all parties.
