OpenAI Suing to Stop B.C. Privacy Commissioner's Tumbler Ridge Investigation
OpenAI says the order seeks records already given to police and exceeds the privacy watchdog’s authority, as the probe examines ChatGPT’s role in the shooting.
On Monday, OpenAI filed a lawsuit in British Columbia seeking to halt an investigation by the Privacy Commissioner into the connection between the Tumbler Ridge shooter's use of ChatGPT and the February school shooting.
British Columbia's privacy watchdog began investigating in June to determine if OpenAI mishandled private information of Jesse Van Rootselaar, who killed eight people in Tumbler Ridge on February before taking her own life.
Demanding all chat logs and internal records regarding police referrals, the OIPC faces opposition from OpenAI, which argues it already provided logs to the RCMP and lacks a "coherent rationale" for the probe.
OpenAI contends the OIPC's sweeping order "far exceeds" its mandate under the Personal Information Protection Act, violates the Canadian Charter of Rights and Freedoms, and "offends the OIPC's own privacy obligations."
Beyond this investigation, OpenAI faces multiple lawsuits in California filed by victims' family members and the government of British Columbia, following reports that leadership dismissed internal warnings regarding the shooter's violent messages.
