Nigeria: Atiku Warns Against 'Forged' Laws, Declares New Tax Act Nullity
Atiku Abubakar highlights constitutional breaches as the gazetted tax law differs from the National Assembly's approved version, calling unauthorized changes forgery.
- In a weekend statement, Atiku Abubakar, former Vice President, said the Nigeria Tax Act as gazetted is a nullity because it differs from the version passed by the National Assembly.
- Section 58 of the 1999 Constitution requires passage by the Senate and House of Representatives, presidential assent, and gazetting, which Atiku Abubakar said is only administrative publication and cannot amend law.
- The National Assembly said it has launched an internal review of processes producing four major fiscal laws, including the Nigeria Tax Act, 2025, while Atiku said post-passage changes without approval are 'forgery'.
- Atiku Abubakar insisted administrative orders cannot cure the defect, saying `No administrative directive by the Senate President or the Speaker can validate such a defect or justify a re-gazetting without re-passage and fresh presidential assent`, and warned rushed re-gazetting would undermine parliamentary oversight.
- The only lawful path, Atiku Abubakar said, is fresh consideration, re-passage in identical form by both chambers of the National Assembly, fresh presidential assent, and proper official gazetting process.
