Alec Baldwin to Face Civil Trial Over Alleged Negligence in ‘Rust’ Shooting
Judge Maurice Leiter let negligence and emotional distress claims move forward, rejecting Baldwin and Rust Movie Productions’ defense arguments and allowing punitive damages.
On Friday, Los Angeles Superior Court Judge Maurice Leiter scheduled a civil trial for Oct. 12 over the fatal 2021 Rust shooting, allowing gaffer Serge Svetnoy's lawsuit to proceed after rejecting defense arguments that Alec Baldwin and Rust Movie Productions bore no responsibility for on-set safety.
The actor was rehearsing a scene at Bonanza Creek Ranch in Santa Fe County on Oct. 21, 2021, when a prop revolver went off, killing cinematographer Halyna Hutchins, 42, and wounding director Joel Souza; Svetnoy alleged the scene did not call for Baldwin to fire the gun.
Leiter allowed claims for punitive damages, negligence and intentional infliction of emotional distress to move forward while dismissing Svetnoy's assault claim, finding no evidence Baldwin intended to cause harm; the judge rejected Rust Movie Productions' workers' compensation argument, noting the company failed to show such coverage was in place.
Following the July 2024 dismissal of his involuntary manslaughter case after prosecutors withheld evidence, Baldwin must now confront civil liability claims, though he has maintained he did not know the gun was loaded and did not pull the trigger.
