The classification of the Hessian AfD as a suspected right-wing extremist organization is lawful, according to the Wiesbaden Administrative Court. The Office for the Protection of the Constitution is permitted to monitor the party. The party had filed a lawsuit against the classification.
Two days after an administrative court declared the Landesverband Niedersachsen an observation case, this also happened to the AfD in Hesse. The party had resisted and in court looked after. This increases the possibilities of constitutional protection.
The Hessian constitutional protection is allowed to observe the AfD-Landesverband as an extreme-right case of suspicion. This was decided by the administrative court Wiesbaden in the main proceedings. There is sufficient evidence that the AfD in Hesse pursues efforts directed against the liberal democratic basic order.
As early as 2022 the constitutional protection observed the AfD, the party proceeded against it. Now an administrative court has decided in the main proceedings: the authority is allowed to do its work and use intelligence means.
The Administrative Court of Wiesbaden sees sufficient evidence for the unconstitutionality of the Hessian regional association of the AfD. However, it allows an appeal.
