Poland Challenges EU-Mercosur Trade Deal at European Court of Justice
Warsaw says the deal would harm farmers and seeks interim measures as the provisional Mercosur trade pact took effect on 1 May, officials said.
- On Sunday evening, Poland filed a complaint with the Court of Justice of the European Union challenging the EU-Mercosur trade deal, Deputy Foreign Minister Marcin Bosacki confirmed. The government seeks to suspend the agreement's implementation pending a final ruling.
- Warsaw argues the deal is procedurally flawed because it lacks ratification and substantively unfair, as South American farmers do not meet the same strict EU standards. Poland contends this creates an inequitable competitive environment.
- Agriculture Minister Stefan Krajewski confirmed the legal action on Monday, stating the government's priority is protecting Polish farmers and consumers. "We promised and we have delivered," Krajewski wrote.
- Although the trade agreement entered provisional force on May 1, Warsaw demands the "implementation and execution of this agreement to be suspended." The European Parliament separately requested the CJEU assess conformity to EU treaties.
- RMF estimates that resolving Poland and the European Parliament's challenges could take around 20 months. Poland remains the only EU member state to initiate legal action against the agreement, approved by a majority in January.
