The Law Offices of John M. McCabe Announces $101 Million Jury Verdict in Retaining Wall Collapse Case
The award goes to two injured workers and one wife after a six-week trial over a 2021 retaining wall collapse.
Following a 6-week trial, a Henderson County Superior Court jury awarded $101 million in compensatory damages for a 2021 retaining wall collapse in Hendersonville that buried four construction workers.
The 12-foot retaining wall collapsed in 2021, burying four workers under tons of materials; a complaint accused Hajoca Corporation of negligent practices, including a lack of necessary permits.
Three workers survived with excruciating injuries requiring years of recovery. Attorney John McCabe stated, "When that wall fell, it shattered their bodies, and it shattered their lives. Their lives will never, ever be the same."
While the jury awarded $101 million, parties reached a confidential settlement as deliberations on punitive damages began. Hajoca stated, "Hajoca disagrees with, but respects the jury," concluding five years of litigation.
Representing plaintiffs Adan Rendon Hernandez and Magno Alberto Valdez Sanchez, The Law Offices of John M. McCabe secured this resolution, marking a record-setting verdict for personal injury cases in North Carolina history.
