My Child Died Scared and Alone, Mother Says at Dudley Nursery Manslaughter Sentencing
The nursery company admitted corporate manslaughter, and prosecutors said Noah Sibanda was restrained face down with a blanket over his face.
- On Thursday, Fairytales Day Nursery, director Deborah Latewood, and practitioner Kimberley Cookson face sentencing at Wolverhampton Crown Court over the death of 14-month-old Noah Sibanda.
- Cookson pleaded guilty to gross negligence manslaughter after CCTV captured her restraining Noah face-down on a cushion with a blanket over his face on December 9, 2022.
- Fairytales Day Nursery Limited admitted corporate manslaughter and Health and Safety at Work Act offences, while Latewood admitted she should have known children were being put down to sleep in dangerous ways.
- Counsel Daniel Cordey read victim impact statements in which Noah's father, Thulani, said his son died because of "gross negligence" by someone trusted to care for him.
- Presiding over sentencing, Mr Justice Choudhury heard the court that covering children's heads to induce sleep was a "habitual practice" at the now-closed nursery involving exceptionally dangerous routines.
