McDonald's must face lawsuit over McRib, US judge rules
The judge said consumers could plausibly believe the sandwich contains rib meat, letting fraud claims over McRib marketing move forward.
On Friday, U.S. District Judge April Perry rejected McDonald's request to dismiss a proposed class action lawsuit accusing the chain of defrauding consumers about the McRib sandwich's content.
Plaintiffs allege McDonald's intentionally shapes McRib patties with ridges to resemble pork ribs, misleading diners into believing the sandwich contains rib meat rather than lower-grade pork products.
Consumers contend the use of lower-grade pork including stomach and tripe caused them to overpay; Judge Perry wrote, "Plaintiffs' proffered understanding of 'McRib' is not unreasonable or fanciful."
McDonald's contended that distinctive product names do not fool reasonable consumers; Thiago Coelho, a lawyer for the plaintiffs, said his clients will continue seeking accountability.
Similar legal challenges have targeted fast-food chains including Burger King and Wendy's, which face accusations of depicting burgers as larger in advertisements than they actually are.
