Mark Mitchell ruled ineligible after Kentucky court ruling
The appeals court said the lower court lacked evidence for the order, leaving 38 athletes without the extra season they sought.
On Friday, the Kentucky Court dissolved a temporary injunction that had allowed Missouri guard Mark Mitchell to compete. The ruling renders Mitchell ineligible, removing his temporary eligibility status and preventing him from playing for the Tigers.
The legal dispute centers on whether athletes from the 2022 high school class qualify for a fifth season of college competition. The Appeals court dissolved a Jefferson Circuit Court order issued Aug. 21 that had initially granted them eligibility.
Judges determined the lower court lacked sufficient evidence to support the injunction affecting 38 athletes. The NCAA adopted a new eligibility model providing five years to compete, beginning with the class of 2023.
Mitchell is currently unable to compete under the ruling. His roster status previously included Gunn, as shared by Every True Tiger Brands Chief Executive Officer and General Manager Marc Moccia on social media.
The ruling does not necessarily end the legal proceedings, as the Appeals court noted athletes may pursue a new temporary injunction through the Kentucky court. Another option for Mitchell is to dismiss his case in Kentucky and refile in Missouri.
