Kelowna daycare operator files lawsuit against landlord, property manager

The daycare says the flood left its largest classroom unusable for 17 months and caused more than $1.2 million in losses.

  • ProducKIDvity Business Services Inc. filed a lawsuit this week against landlord Bernard Block Office LP and property manager Colliers Macaulay Nicolls Inc., alleging negligence, breach of contract, and defamation following a lockout of its downtown Kelowna childcare centre.
  • The suit traces the conflict to a December 23, 2024, flood that rendered 75 per cent of the sixth floor unusable for three months; this damage forced the closure of the Balsam Room for 17 months.
  • Although ProducKIDvity attempted to pay $34,897 toward disputed arrears, the landlord refused the funds and locked the facility out on May 29, leading the daycare to claim losses exceeding $1.2 million.
  • The suit further alleges defamation, claiming Colliers posted a false notice at 1499 St. Paul St. stating the business was "no longer in operation," while parents discovered the closure through a communication app.
  • Neither the landlord nor Colliers has filed a legal response to the claims, and none of the allegations have been proven in court as the daycare remains defunct.
