Justice Department alleges misconduct by ‘all but one’ Minnesota federal judges
Attorney General Todd Blanche said the complaint seeks recusals in DHS cases after judges gave interviews about Operation Metro Surge and pending immigration rulings.
On Wednesday, Sept. 30, Attorney General Todd Blanche announced the Justice Department filed a judicial misconduct complaint against all but one of Minnesota's federal district judges, alleging ethical breaches regarding media interviews.
The complaint follows interviews Judges Patrick Schiltz and others gave to The New York Times, where Schiltz described the government's actions during Operation Metro Surge as a "grave threat to the rule of law."
Federal judges are barred from discussing pending cases under the code of conduct, leading the Justice Department to request these judges recuse themselves from all cases involving the Department of Homeland Security.
Prosecutors currently target 15 anti-ICE activists, intensifying a fight where judges previously ruled against the department in more than 70% of around 1,000 habeas corpus cases.
This conflict reflects a broader struggle between the Justice Department and a judiciary often acting as a bulwark against President Donald Trump's expansive view of executive powers.
