Jury Selection to Begin in Federal Hate Crimes Trial over Buffalo, N.Y., Supermarket Shooting
Gendron faces 27 federal charges, including 10 hate crime counts, and prosecutors could again seek a death sentence.
Jury selection began Tuesday at the Buffalo Federal Courthouse for the federal trial of Payton Gendron, who faces over two dozen federal hate crime charges and more than a dozen firearms charges.
Already serving life in prison for state murder and domestic terrorism convictions, Gendron now faces federal death penalty charges for the May 14, 2022, attack at the Tops Friendly Markets on Jefferson Avenue.
The shooting killed 10 Black people, including 86-year-old Ruth Whitfield, after Gendron drove over 200 miles from Conklin and fired around 60 shots from a semiautomatic rifle.
Victims' families hold mixed views on the death penalty; Buffalo Common Council member Zeneta Everhart, whose son Zaire survived, said "Yay! Go for the death penalty.' That's never been me."
Although New York does not carry out executions, federal prosecutors can pursue capital punishment under dual sovereignty; the U.S. Attorney's Office would designate another state for execution if Gendron is sentenced to death.
