Jewish rabbi sues Maryland County gun ban in houses of worship
The lawsuit says the rule blocks a rabbi from walking to synagogue and bars licensed volunteer security from carrying inside the building.
- On Thursday, the Silver Spring Jewish Center and Rabbi J. Menashe Shapiro filed a federal lawsuit challenging Montgomery County's Expedited Bill 23-26, which bans carrying firearms within 100 yards of places of public assembly, including houses of worship.
- Signed into law by County Executive Marc Elrich on July 27, the ordinance took effect immediately and disrupts security plans, as Shapiro's commute to synagogue requires walking within 100 yards of two public schools, one private school, two parks and three other houses of worship.
- Shapiro argues Jewish law requires communal self-defense, while New Civil Liberties Alliance attorney Mark Chenoweth stated, "Such interference in the internal management of a place of worship violates the First Amendment, too."
- Plaintiffs seek a preliminary injunction to block enforcement, arguing the ordinance ignores the Supreme Court's Bruen precedent, which ruled that "proper cause" requirements cannot be imposed for concealed carry permits.
- Citing the October 7, 2023 attacks in Israel and recent local threats including an October 2024 assault and a June 2026 attempted break-in, the synagogue contends that restricting armed volunteer security teams creates a fundamental threat to congregant safety.
